Charge offs, Cap one, new credit cards,

I emailed you a couple of months ago and opened a couple of new credit accounts and stated improving my score, however I followed your site's advise and got my 3 bureaus report and now it seems I have old accounts (telephone, cellular) as charge offs and this is odd I have information on a mortgage (41000) that my father did when I was 8 years old an appears on my report as joint.Any advise??? I am closing the Cap1 card ASASP.
On freecreditreport.com it says 632 ,why???the difference. I am working for the Fed Gov't and need to raise my credit. Thanks and regards

Closing cap one might mean a 50 point increase.

I recently pulled my wifes credit report from truecredit.com which shows all three reports and notice that a medical collection is on there and has been paid. It shows paid with a zero balance. How do I get this off of my report. Also the collection company hit the report for an inquiry. I wrote them a letter asking where there were given permission to pull the credit report and haven't heard from them yet.

Any help or guidance would be appreciative.

How I might improve my credit score? I realize now that paying 'cash' for things the last 5 years was probably not the best thing to do for improving my credit report. I do not presently have a credit card. Is there a way to get one and use it to quickly improve my credit score or do you have a better way for me to improve and continue to improve my score. Thanks for helping all of us out here.

You gotta have 1 year on the books so ya better get started now.
I get or keep at least 3 reported and open current paid on time credit cards or loans that have been reported at least 12 months.
Best and only way.

Your website is very good in helping me understand that I may be able to build some good credit down the road.

The last time I checked my credit report was in 1999. I still have the copy. It's difficult for me to even look at the report. I have such shame for not paying these bills. At this point the reasons don;t matter. I just couldn;t pay.

Can you please give me a step by step on what to do going forward. I just don;t know where to begin.

I guess I should start by obtaining my credit report. I was advised by my attorney to not even inquire as to my score for at least 7 years from the time I stopped paying on these credit cards. That was 1999.

You web site says that after 7 years charge offs, collections, and past dues drop off. Am I too understand that after 7 years my credit report will show 'nothing'?

I would appreciate any advice you can give me.
--------------------------------
Yes in 7 years your report will show nothing if you owe nothing
Get 3 lines of credit
ccard

car loan

try a local banks' endorsed credit card Keep it one year then go for a loan

Thanks. I'll get started.

Chapter 7, Judgment removed from credit report, 7 years

I filed chapter 7 bankruptcy in va w/out an atty. All went well w/the creditors meeting on 5/22 and my current credit report reads; chapter 7 voluntarily discharged. however, i still have judgments on my credit report most read N/A under status and most are date from 2001 to 2004. how can i get these removed from my credit report?THANK YOU!
Get Judgement removed from credit report.
-----------------
"majors@oskie.com" / to Get Judgement removed form credit report /8:29 am
Judgements are matters of law that are not only permanently in court documents but are also filed on your credit report for 7 years and are not removable.
If the Judgement was not carried through in court and you included the account that was to be judged in your bankruptcy before the Judgment was carried out in court, then you might get them removed.
So you tell me what happened.
I would say they are too old to worry about now as they are both more than 2 years old. Get new good credit started here and do not look back.
http://www.credit.com/r/problem_credit/af=p39646&ag=
keep one or 2 of these open one year and your score will steadily rise as long as you do not go late on anything anymore.
--------------------------------
I thought they were too old to worry about as well. I think the last one was filed in 2004 HOWEVER i was looking into getting a mortgage as a first time homebuyer w/a cosigner and was told that until the judgments are removed i cannot get the mortgage as they will attach my house for pmt.
I did call 2 of the creditors and asked them about these judgments and they told me i had 2 options 1) pay them and they will remove them or 2) sue them
I said well i can't pay them (they are over 15000.00 medical bills) and they were included in my bankruptcy. she literally said"too bad then sue us if you want them removed"Is that even legal to do?thanks for the help
-------------------------------
I am sorry to say YES that is perfectly legal and their right by FTC law to collect monies owed.

Like I said before.
Did you get judged before your bk or or after?

If it was included in a bk and you have papers stating they were included file that to say the judgement has been satified as it was included in you BK.
use this form and maybe a 50 word letterSend it to the bureau and say account not reported accuratly. Included in BK. Paid
http://www.oskie.com/credit-dispute.htm
-------------------------------
I do not think that a prior legal judgement can be included in a BK.
matter of law
-------------------------------
so i do need to file a motion to avoid lien then? thank you for your help. I'm pretty surenow i will need an atty at an expensive cost. how can they not act on a judgment yet leave it there? i'm looking at my credit report as we speak.all of these companies were included in my bankruptcy and still they are not reporting as such. I did have 1 creditor who had a judgment against me, when i filed the bankruptcy i recieved a letter from them stating that the judgment had been cancelled. ?? why could they do it and not the others?
-------------------------
http://www.oskie.com/after-bankruptcy-credit-report-repair-credit-card.htm
read the first part of this page
I do not know. But I guess you filed for BK before the judgements went through court
thats like my third time to ask that question.

I would say if the accounts were included in you bk please use this form and make sure the accounts are listed as they should be.
http://www.oskie.com/credit-dispute.htm

Wow

I am not a legal consultant but it sounds to me like you need some legal advice.
Might try a bankruptcy forum on yahoo questions. usually a lurking lawyer will answer the leagalities of issues.

Of course credit reporting is fraught with errors and most misreporting can be labeled as just an error or oversight when in fact it was intentional and deliberate to make one credit bad in light of non payments.
------------------------
I apologize but i thouught i answered that questionn. Yes they were filed before my bk. some were filed in 2001!and are listed as N/A (i think that mean no activity) I appreciate the help you have given me thus far. I will take it under advisement and also contact a bk atty for a free consultation too see what they say.THanks again! You have been a helpregards,

Hello Bo, My email is in response to this statement I've seen about Capital One on your blog."They report your credit limit as being whatever you charge so you are always maxed out with them."I have two questions. First, on our credit report it shows a largest past balance and then a current balance for Capital One. This is on both of our Capital One cards. If the way they report it leaves it appearing to be "always maxed out," how does this largest past balance affect our score? Second, if the account is zeroed out but left open how does that report/affect our score? I am hesitant to close our Capital One accounts because they are the oldest in good standing accounts we have open. I look forward to hearing from you soon.
Thanks for the help!

I guess in your situation i would keep it open too. But never have a balance
I guess you have some other credit too.
If you do have 3 other good credit lines then the capital one should be closed.
If not then keep it open but do not use the dern thing.

Captial One Credit Cards. My Fix Credit Free Help

You probably dont remember me emailing you for your advice i read on your website, but it had to do with the capital one credit cards. I told you i had four of them and my score has been over the years staying around 560 to 599, and using your advice i paid them off all four of them, and closed them in good standing. i then opened four new ones with hsbc. my score has slowly been climbing ever since. i spoke with you back in febuary, and score climbed from 565, 588, 601,618, 670, 745. 745 is july. Talking about WOW! just getting rid of capital one is all I did using your advice. I want to thank you, cause if it had not been for me reading that advice on your website, it would have not happened. Thanks a million man! Mike from Texas.

Authorized User, raise credit score, how long?

I had been trying to improve my credit score for the past 3 months. My scores have risen very little. The are 591(equifax), 603(experian) and 623(trans). I just added two trade lines to my account as an authorized user on7/10 with 7,500 credit limit and 7 years of history but my credit score did not move. How long does it take for the score to increase? Thanks,

they just came out with a new score system which cuts the piggy back autorized user thing out.
You must have some bad stuff that needs to be paid or removed and some is recent.
So get recent good credit. In 1 year your score will go up 50 points with no new bad credit and all new good credit and all past balances zeroed out.

I was told that the new system to stop piggybacking would not role out untilseptember for one bureau then the other two bureaus would pick it up laterin the year.

Probably so.
My intention was to say.

An “Open” status even though they list as “paid/less than full balance/charge off.” I paid these off two years ago.
Total number of open accounts for experian are 5, Equifax open accounts are “10” open accounts, thus I was thinking
Of closing the “open” capital one accounts, as I can see no real difference between experian and Equifax accounts other
Than 5 more open accounts.

I also noticed my home lender while lists on Equifax, reports no data N/a for payment history.
I am going to refinance in November for a better rate so I thought I’d start the process. I haven’t seen any info

A credit card cannot be open and charged off.

Capital One is not the credit one needs so close all of them you can. They report whatever you owe as being your high credit so your card is always maxed out. That is bad.

I would concentrate on making sure I had 3 open accounts that are being reported and wonder aloud why your mortagage is not showing details. I would call them. Now.

Medical bill collection unknown. Inquiry or credit report pulled by collections agency to find my address
-----------
A part of my medical bill was denied by my insurance leaving a balance of $116 which I was unaware of. The doctor's office claims to have a bad address and they do not make collection calls so they passed my debt over to a collection agency. I feel that in this case a call is warranted if mail is being returned; they must have written the address down wrong. Then it went out to collections but they did not pull a report to obtain my address. My address is current on all reports and I had mail forwarding set up. So... did the collection agency have the obligation to pull my report in order to obtain an address?
--------------------------
"majors@oskie.com" / to Inquiry on unknown Collection /
Abosolutley NOT!They cannot pull your credit report unless you sign for it.
If you have an inquiry on your report from the collection company, then ask them to kindly remove the debt and inquiry from your credit report, plus send you a signed letter on company letter head saying such has been done as required by FTC law. No one may pull my credit report up without my signed consent.

I have a capital one card that is very old and I know it has gone to collections, but I don’t know which collection agency. I have contacted Capital One since they are still listed on my credit reports as the creditor, and they cannot find the account in their system. I have disputed and disputed, but they come back and say the debt remains, even after they sent me a letter stating that they cannot locate me in their system or tell me what collection agency may have the account now.

What should I do
---------------------
Dispute the collection. I guess the capital one is not going away. You have tried. I assume you used certified delivery mail with copies of any documentation you have or should have saying not in the file.
I would tell you to re open with capital one but they are bad. So I will not. They report your credit limit as being whatever you charge so you are always maxed out with them.

I have five late payments on my record from a closed account with Bank of the West. I have sent two letters trying to get the business to have them removed and not punish me for the full seven years. The Lexington Law firm advertises their ability to get them removed.
Can you give me any direction or advise about getting the five late payments removed on this paid in full account.
Thank you in advance for you help.

I don't know if it makes a difference, but many of the bills were for my daughter, which my ex-husband eventually paid me to pay off. However, I'd really like my credit score improved, as you can imagine. What would you suggest?Peggy

I am currently caught up according to Sears and the Sears Card Reps from Citibank are constantly calling to get me to reopen my Card. I spoke with a citibank rep and one thing he told me was that he showed lates on the Sears card in his system. My concern is my Transunion credit report has not reported any lates (0x30,60,90,120) for my sears card at all. Will reopening my account affect my credit score negatively? If I do reopen the account could the new reporting to the credit bureaus activate my account showing lates on it? Is having a "closed by creditor" and paying a card off better on a credit report than paying off an active account with lates recorded? My goal is to get to a credit score of at least a 680. Thank you for any information that you can give me for this situation, it is greatly appreciated.

I still receive a phone call or form letter every few months, but I've never answered them or acknowledged them on the phone. I was wondering if this will come off of my credit reports on Feb. 2010? Do I have to take any special action? Is there anything the collection co. can do to keep it on there, like sell it to another co, for instance? Anything else I should know? There is a distinctly high chance for some other action is possible by the collector because as you state they are able to contact you: 1 Suit? 2 Re Date like you state by selling to another collector or small claim
Not talking to them might work but I would rather pay them and negotiate if at all possible, especially if, the collection is a result of inablity to pay something I signed up for and agreed to pay in the first place.

One thing I need to address is that more often than not good credit is a direct result of stable workable income. If I can not pay what can I do?
-----------------------------
Thanks for answering. The collection is for a student accounts balance (not a student loan, so it would eventually fall off.) I am in the position to pay something now, but not the whole thing. I also don't want this to drag on any longer. My credit score is 675, and I'd like to pump it up a bit more to purchase a house soon. How do I negotiate with them so I don't have to pay the full amount? How much on the dollar can I expect to pay? Should I negotiate with the original creditor or with the collection agency? How can I be certain they'll take the record off after I pay?

Employment does affect credit decisions if some one applies for credit several times and each time the job shows up different.Potential creditors might say: Hey this is a job hopping, credit applying, unstable person.

Pay them off if they are at least 12 months old, or keep them until they are, and make sure you have at least 3 open lines of credit.

No

In April of 2006 I was contacted by adebt collection agency who said I owed $215.56 to Mervyns, which was 3 years past due. The agency said that I could clear this debt and settle for 75% of the $215.56, which amounted to $167.67. I did so. Since April of 2006 I have been notified by 2 different debt collection agencies, stating that I owe $53.00. I pulled my credit report recently and it shows that I have 2 delinquent accounts with the EXACT same account number. One delinquent account is with Mervyns and one is with LVNV funding, which says I have a "credit limit" of$53.00. However, when I sent in the settlement letter that I received from the debt collection agency I settled with, the new colletion agencies say that the account number on my Mervyns account DOES NOT match the account number on my settlement letter. I don't know what to do because I am POSITIVE that this is my only delinquent debt, andthat I settled it in 2006. I kindly ask for your advice because I feel helpless and I am exhausted from getting the run-around from these people. Please find attached the letter that I sent to the disputedepartment of both creditors on my delinquent accounts.

Filed chapter 7 7 years ago. Will my credit score increase when it come off my report?

I filed a chaper 7 in early 1998. When it is deleted next year Im hoping my credit score will increase. I haven't been able to find any info on how much it will impact my credit score. Do you have a rough idea how many points a persons score usually goes up when a Chapter 7 comes off their file??

Thank you

It should have almost no impact
IF
you are already "Working the Credit Help Program"
you have 3 open and rated lines of credit.
All of which should have more than 2 years on the books by now.

It will have very little impact if any
2 years back from today is 80% of your credit score.

You might get 10-25 points.

I am having some difficulty submitting two disputes with Experian as I have already disputed these items w/ them in the past. When I attempt to submit another dispute the website prevents me from doing so saying the items have already been verified. How do I proceed w/ another dispute? One of the items was removed several years ago and has since reappeared. Thanks again.

I will say that they frown on continued disputes of the same order.

Send in documents to support your cause and /or call the company reporting it and negotiate.
Sounds to me like the company is not supporting your cause and re submitting your bad credit.

I am working on cleaning my credit and my credit report. I have signed up for TU truecredit and check my scores daily as well as checking my accounts.
They sure don't make things easy for you but... my question is this.

I got my score from Experian today at the same time I got my score for Experian from TrueCredit. They were not even close.

Equifax directly said my score was 582 and TrueCredit said my score was 601 for Equifax. Why the discrepency? How do you ever know what scores are correct or when they were last updated if there is such a distinct difference between the two?

Is there an easy way to get the report a mortgage lender would see or can you only obtain one through a mortgage company?

I would like to get my score up high enough to qualify for a decent mortgage this time next year. Almost all my old accounts have been paid or deleted and I've had one late payment out of 15 accounts in the last two years. My biggest drawback as far as I know now is percentage of available credit and no mortgage or "other" revolving accounts other then credit cards.

Thank you in advance for your answer.

20 points might be explained if there was a time difference in the pulling of the different reports.
If not maybe one reports lists something theother doesnt by accident
BUT
The score should be the same even though I would call 19 points as being almost of no meaning.
The score you want is 640+ to qualify for decent rates and 720+ for perfect rates.

Dispute stuff.Keep stuff open and good.Negotiate stuff.
In less than 2 years your score will be 720's

I have a collection agency that has listed a balance of 2190.00 for a car they say I purchased in 1999. They have my maiden name of when I was married and the balance was 771.00 but with interest each day it continues to go up. I call the collection agency and asked who the original car dealership is because I have never owned a Toyota and they stated they didn’t have it because they bought it from another collection agency. I ask is they could mail me a copy of the signed contract and they told me to call back in a week they would try to find paper work. They stated they mailed correspondence to my parent’s home address which I have not lived at since I was 19 years old over 21 years ago. My report states it will be on there until 10/07. with me pursuing this can they extend another 7 years of this on my credit? I am currently trying to refinance my house and can’t because my credit scores are below 500 and I am looking at paying an increase of almost $400.00 due to my adjustable rate kicking in starting 9/1/07. Should I use the dispute letter to the credit bureaus first or should I send the letter you have posted for collection agencies to try and get them to remove this off my credit?

"Consolidated student loan three times and 2 still show bad on my report."
I have consolidated my student loan three times. According to my credit report it seems that I have 2 loans that were in bad standing and one that is current. Even though I defaulted on the two previous loans, they were taken over by the William T Ford federal program. I have been current with this current loan for over a year. Why are the two older loans still listed as negative information when they have been paid off?

Hi Bo, I’ve had a Chapter 7 discharge since Jan. 07, that included a foreclosure. The 1st , 2nd , and one credit card are still reporting me 120 days past due. Are these creditors required to remove their info from my report, or do I need to send dispute forms? Thanks for your help, BJ

No creditors are not required to remove bad credit marks from my credit report when I file and discharge a chapter 7.
In fact all bad payments will show for seven years.
The worst effect is for the first 2 years after the bad credit's "date of last activity".
So it is very important to get and keep new good rated credit.

Car repo removed from my credit report be creditor

My credit score is 658 and I want to raise it so that I can qualify for a better mortgage payment on a new home loan in about 30 days I contacted the original creditor who said they would remove it and also send out a letter confirming that removal from the credit report. However that was told to me 2 years ago when the accout was paid and it still is not remove. What can I do to have this removed so that my credit score can raise. Also it is making my debt to income ratio look rather shaky because it shows that I have two auto loans for more than I can pay. When I got my divorce, I agreed to sign over the house to my ex-husband and he agreed to re-finance and get my name off the loan. He also agreed to have my name taken off all the credit cards he opened without my knowledge and listed me as the second party on. A year later he has done none of those things.
I have contacted an attorney who says it could take up to two years to take him to court and hold him in contempt, for whatever good that would do.
I have also been told that I can attach a letter to my credit reports to show that I am no longer responsible for those debts and attach a copy of my divorce decree.
My question is, what is the simplest and most straight-forward way of doing that? And most effective, as I am now thinking of moving back to the States and buying property and afraid that these things will have a negative affect on that process?

Thank you for your help.

Dispute Captial One mistakes on my credit report

I am writing to ask a question about a letter I sent directly to Capitol One about 2 debts that show on my credit report. (I have attached that letter)
I have only had one credit card with them and not sure which account number it was so I disputed both entries. I think the statute of limitations is up on them, but not completely sure. The letter was mailed certified on March 26, 2007 and it was deliverd on MArch 28. To date I have not heard a word from them, despite the fact I included my address and asked for a response within 30 days. I had also disputed this with Experian and the very next day they said they verified the information and no change would be made, but they have failed to explain how they verified the information or the accuracy of the verification. If Experian verified it so easily then why has Capitol One not responded?
I am not sure what my next step should be. I have been cleaning up my credit for the past few months and the paid items still look like negative entries.
It just seems to me that if you try and make right on the negative it still remains for 7 years as a negative. May as well not pay it and wait for it to expire.
I will be glad to scan a copy of my report for your review so I can get the most accurate advice.

I currently have 2 credit cards and plan on getting another to get new rated credit as you advised. My only question on this is where you say to keep them under 30%. Do you mean carrying a balance of more than 30% is bad because I always pay my balance in full every month so does the 30% rule still apply to me if I max out the card but then pay it off before the due date each month. I would ask the card to raise my credit limit so it did not need to get maxed out.
This is not bad really but make sure if you go to get credit you have paid that one down to less than 30% and you will be OK.

I have a Sears Credit Card account. This account is 16 months old and currently shows in my credit report "closed by creditor" for about 8 months now. I entered into a repayment plan that is automatically deducted from my checking account each month, and have paid them ontime since the account was closed 8 months ago.My Trans Union score is a 642.

Also, if I do end up in negotiations with the company, how much should I offer to pay and how do I ensure that they will remove the record from my report? -- Best Regards,

Which is not true, But of course they are not going to change the information. Also at the same time. There was a collection agency that had a Hospital bill that was my daughters. I was paying on the bill but not to there expectation so they sent it to the credit agency. I called them and did go ahead and paid it in full. But they are still reporting it has not paid. See if they can meet all these requirements legally. If not they have to take it off.
Plus once you they accept a payments plan they cannot take you to court as they accepted another amount. They can report you to bureaus. But you have some leverage on getting the account removed and I would try to use some.
As far as the credit cards go....it sounds as if you have already done the right thing to no avail.

sounds like your a mess
the credit cards happen alot
What really looks bad is utitlities not paid on your report and repos meaning more than one.
whew.
Repos will take most credit opportunities away from you and collections for utilities show no stablity at all. How can someone be loan monies if they can not even pay utilities.
Most bad credit comes from lack of money or job problems so don't give up. We all have slick spots.
Pay the utitlities and try to repopen the same accounts and after 1 - 2 years call and beg them to remove the past lates.

You might dispute the repos and hope they fall off.

NEVER use capital one and pay them off for sure.

Go to my website to get the dispute form and start new credit form.

I would use some of my monies to pre pay on a credit card to get it opened with bad credit and try to get some good going, so the old bad looks just like that. OLD.
