Quoting REAL PERSON
I've been reading your inquiries and I need your help. Here I have contacted an attorney to solve my issues when all I really needed was your e-mail.
I have three creditors. IC Systems who I paid off in 10/2002 although I paid them off in 10/2002 the company never showed up on my credit report until 3/2003 and 6/2005. When I disputed the account on Equifax they removed it stating they had the wrong
social security number, which was a lie. I've been going back and forth with them to update the dates on my credit report, they refuse and my lawyer (lack thereof) has said it's pointless to dispute it through him all I asked him to do was prepare a letter. How can I ensure that they update the dates on my credit report to reflect accurate reporting?
First Premier Bank, I settled for a lesser amount and yet they won't update the current status to just Settled Account and leave the other junk off, is there a way I can get them to do this, again my lawyer refused.
I read on the internet how lawyers can settle accounts for their removal, is this possible, have you heard about this and is there literature on things like this happening?

i will say that just becuase one files bankruptcy
settles and account
pays off a collection
does not mean they are entitled to have all the other real life credit problems taken off. If you did;nt pay a credit card. they charged you to collection and then you settled. It does not mean the bill did not get late or that it was not sent to collections. I think many people believe once they pay that all past negatives go away. It's kind of like the thing I here every day. I have great credit. Sure you paid them off but look how many times you were late. There is way more than just paying someone off to good credit.
I not saying any of this applys to you. These are only things I see day in and day out.

the payment was there on time and it didnt get posted
Quoting REAL PERSON
I wanted to see if you can help me. One of my junior loans posted a 30 day late and brought my score down. i'm now in the lows 600's however, the payment was there on time and it didnt get posted because the last two digits of the account numbers were wrong. what should i do? i contact washington mutual in which i have my loan from and they don't want to take it off my credit report. they show the payment was there on time, but didnt post because of the account number.
REAL PERSON
---------------
that is thier mistake if you can show it cleared your bank on time
they should remove it due to thier error
evidently they must think it is not
30 days is thew cutoff and that IS a long way from on time
but the letter of the law says they cannot report you late until 30 days.
Collections and 2 charge offs. My score has been around 540 to 560
Quoting REAL PERSON
Hi Bob,
I first wanted to say I appreciate the work you have done with you site. Question my score has been around 540 to 560 for the past 8 months. I have collections and 2 charge offs. 8 months ago I decided to get my credit and life under control. I started paying off the collection. All of the collection company refused to remove
the collection notice when asked. I tried to enroll them with kindness and hoping they would be understanding that we had problem that was out of our control. Did make any difference. I have all of the collection paid off except one. From what I have read it looks like my score will not improved until the collection notice expire even though they state paid on collection zero balance. It seem I have went about it all wrong. I am very discouraged.
By the way, we have not been late on anything for 2 years. I have only 2 trade line open. Car, and house payment. I don't know if student loan qualifies. Any advise?
-----------------------------
To be more complete I would have to adivise people with collections to do more than make payments on collections and THEN ask for removal. Catch collections fast and pay them in one lump sum with penalties and ask for total removal if you complete the payment with a letter you can use to dispute the collection. Most collections only show up after repeated contacts. So when collection hit everyone knows this has been a total lack of payment after prolonged attempts to contact. Add that on top of making payments rather than lump sum. What really looks bad collection is Utilities (phone, eclectric, gas, water, rent) and previous creditors turned over to colections. Hospital stuff usually doesn't hurt as bad other than all people now that hospitals try to set up payments before they send items to colection.
But alas there is a rainbow. You have paid them off. You are making new strides with 2 open trade lines. Your score will follow positive feedback over time.
Hope the collection companies go out of buisiness later and you can dispute them. Always dispute unfamiliar accounts older than 4-5 years in hopes for removal. I assume your collections are not duplicates of another account reporting creditor who could not collect from you. If this is the case I would dispute on
the basis of duplicate accounts.

My Problem- This is a example of one of the cards.
Quoting
Hi Bo, I love your website. I have a question or a problem and I hoping you have an answer. My credit report is a mess and I have read all most everything on your site and I have been working on my credit report. I have sent out 20 letters and I'm not getting any thing fixed. The Problems is: I had 4 credit card and lost my job and fell behind on them. Before I could get back on my feet the credit card companies: wrote them off, and then sold them to someone else. I tried to settle them but I didn't have enough money, so each company again wrote them off and each company sold them to someone else. This happen at least 6 times for each card. In the end, the cards each got sold and some of the companies didn't even notify me. The total amount of the cards was about $1500. At the end I settle with all 4 cards for over $5000.00.
My Problem- This is a example of one of the cards.

I sent a dispute form on them asking them to charge it from wrote off to Payment after charge off-Settled less than full balance. And they will not do it.I sent every piece of paper I could to help them understand but they still will not fix it. My question is ? How can a company write a debt off, take credit on they income taxes for the write off and turn around an sell it to another company that does the same thing all over again?
Any help you can give me, I would be very thankful for.

an account was settled-is that a bad mark that will lower your credit score
Quoting Real Person>:
If you have on your credit report that an account was settled-is that a bad mark that will lower your credit score? Also the information I read on your site was very helpful.
Thanks,
NJ
---------------
Yes it usually is. It says beside how they rank your activity r or i 1-9 9 being bad and 1 being good. r = revovling credit like credit cards. I = installment loans like cars and houses.
settlements mean your account was not paid in full as agreed but usually do change your outstanding balance to 0. For the most part i think and no one knows for sure that a settelment out weighs a 0 balance thus maiking your score lower. how much? I would venture only a guess of up to 40 points on a perfect credit report and as low as 10 on a really bad report.
All guesses.

How are you..... I'm trying to prepare to buy a home ,but my credit score I'm thinking is to low ......its 633 Equifax, 642 Trans union and 661 Experian I got these from a credit report Bank of America did for me from a company called PrivacySource. This repot also shows credit report keys, credit report details, and credit report disputes so pretty extensive as you can see.I have a bankruptcy that I'm hoping will automatically fall off my credit in Oct. 05 it will have been 10 years by than. Will it drop off automatically? IS THE DISHCARGE DATE 10 YEARS AGO? yES NOT 10 YEARS FROM DISHCARGE NO I also have a couple of Medical delinquency that I'm trying to figure out how to handle.I'm not even sure I owe this money. If I do does these types of delinquencies lower my Score? Should I try and contact them to make a arrangement to pay them ABOLUTLEY.....should I ask them to please consider to dismiss the charges? I truly can not afford to pay them if they are mine. Every dollar I'm making is going towards trying to prepare to buy a home meaning the down payment and things like that. I really need some guidance I'm a 43 year old single guy living in my Fathers basement I lost my mother a few years ago to lung cancer and its just time to make a move. The bankruptcy was a major Mistake its been so crippling , but its been ten years now and I'm pretty sure I make enough money to invest in a home (48,000 a year). I've paid down my credit cards I had 4 a year ago and now I only have two with a balance of like 1,000 between the two. MUST HAVE OPEN CREDIT AT ALL TIMES TO HAVE A SCORE. NO OPEN CREDIT IN THE LAST 2 YEARS? NO SCORE. I realized I made a error by closing all 4 of them last year after doing some research this is why I really need help I just don't know what I'm doing.I don't have that much debt really just things like a car payment which is in my dads name ( cosigner) I did it that way to get a better interest rate the payment is $450 a month.I'm hopping to find another car that cost less to cut that payment in half after the bankruptcy falls off my credit report this Oct. I figure I could than go car shopping for a cost of about 10,000 for the car so my payment would only be $225-> $250 a month. Does that sound like the right game plan there? so I can free up more monthly income for my mortgage payment. The other debt is cable bill, cell phone, car Insurance. Things like that. Thank you so much for taking the time to read this and any suggestions you could offer me or direction or any advice I would greatly appreciate. THOSE SOUND LIKE UTILITIES THAT VERY RARELY WORK WITH YOU. PAY THINGS OFF. ASK FOR HELP AND BEG.

What I really want to talk about here is the fact that attempting to contact Equifax and Experian by phone is nearly impossible!
Quoting sandra REAL PERSON>:
Hi Bo,
I just happened to find your site from Google and I would like to say it's really imformative! Recently, I have been trying to refinance my home and get what they call a 'cash-out' and I applied through the company that holds my mortgage. They turned me down due to too many 'hits' on my credit history. I don't understand why this is such a detriment on a person's credit and I know there is no way to change the rule or law but it really makes me upset. In fact, it's so bad that those 'hits' remain for 12 months or more.
What I really want to talk about here is the fact that attempting to contact Equifax and Experian by phone is nearly impossible! I was able to contact Experian by telephone after sitting on the phone for about an hour, being re-routed numerous times and after calling about three or four different numbers. I was able to dispute many errors I found on my credit report that I had no idea was there. In my personal information section, they had about ten
different names for me, all of them incorrect, my birthdate was wrong, there were several addresses that were incorrect and even my drivers license number was wrong.
Contacting Equifax is a completely different story. I stupidly signed up for their $9.95 a month credit report but had intentions of terminating it before the thirty day offer was up. Well, here is the problem....
It's really easy to sign up and REAL easy to enter your credit card
information so they can take your money but it's impossible to terminate your transaction! I searched and searched the site for the link to terminate my transaction, I'm STILL searching, I am searching for a way to contact Equifax and unless I am going blind, I cannot find the feature to end my membership. By the time I
send a letter by snail mail, Equifax will have sucked another nine dollars from my account.
If you know of any way for me to terminate my subscription with Equifax,
PLEASE let me know!!!
Thank you and I will add your site to my favorites.

Settlements with creditors. Will these help my credit score
Quoting Real Person>:
My credit report says that I am about $1,300.00 in debt. I want to settle with the people that I owe, but with all the other bills I have it's kinda hard paying the full amount. My question is, do you think that the creditors will accept a reasonable settlement because I'm unable to pay the full amount? For instance, 1 company I owe $140.00, do you think they will accept $100.00 as payment in full? If so, is there a form letter for something like this. Please
give me any help that you can. I want to buy a house and my credit score is 600.
Thanks.

The convoluted web of making contact has made it an impossible task for me to find fax numbers
Hello Bo, I am RP, I live in DC and I am an engineer, going about to get some information cleaned from my report - that I never knew existed. I found it admirable that you took the step to list and help with this information. Your website was also very very informative. I am writing to ask if you could provide me with some additional information. The convoluted web of making contact has made it an impossible task for me to find fax numbers and such. I have papers with proof, letters of apology/recalls etc from the company in some cases the company reporting cant even find reference to their record.
Could you send me information on their fax numbers and contact emails, where they can't ignore my documents, and whom would I contact, hoping this will cut my time in following the trail. Also in your opinion what was the fastest and most effective way to get the items resolved. Also any suggestions on what to do to keep them/organization from doing the same stuff ever again.
--------------
use certified mail
sent it 3 day if your in a hurry
forget the fax
it is not worth the trouble and mail is more secure
---------------
RP
Will give that a shot. Thanks again Bo.
When I got my report I had 6 rated at R and U9, needless to say I was shocked, and moved very quickly. I got 4 of them resolved; the Companies have all sent me either apology letters or correcting the error and sending me a report to that effect. However, I am facing a problem with ATT cable and ATT wireless; both are now owned by other companies like Comcast cable and Cingular Wireless. I have paperwork, for the both of them, but it has been impossible to get any form of resolution because I get shuffled back and forth between the credit agency and the companies. Any clues on that. I wrote them numerous emails, called them so many times, the facts
in their system even reflect my statement, but they simply refuse to
issue me a letter or a point of contact to deal with.
What can I do in this situation?
----------
when a company is "bought out", so are the debts and assets.
your debt or assest or mistake was passed along then put into like a
mass grave site. Many of these items will come right off with a dispute form.
I'd try the dispute form then see what happens.
-----------
When you say a dispute form I am assuming the PDF/word document you put together on your website.
Also I looked into the 3 in 1 credit service at credit.com you listed, does interacting with them and furnishing paperwork to them, mean they can fix this directly as in they have direct access to the database and such. At some point, if your website allows for it, I would also like to contribute to your website anonymously, but have nowhere the same depth as you do. Also did the credit bureaus try to get you to take any off the stuff down... it was so hard trying to find information on the stuff.

this company bought a debt that was already charged off by another company
I have an item on my credit report from Asset Acceptance which claims to be a collection account. However, this company bought a debt that was already charged off by another company. Now this company claims that I owe them (not the company I actually owed that already charged this item off). When I called them, they admitted on the phone to me that they BOUGHT this debt from another company and that they're not making a collection specifically for the company they bought it from since it was charged off.
Do they have the right to report this on my credit being that I do not physically owe them a cent? They're a business that bought a debt in hopes to get money out of me... I can't see this being legal. I disputed this item on my credit but it came back as OK because it claims on my credit that they're are a collection for the previous company Bank One) and they aren't! Bank One already charged this item off years ago and then sold it to Asset Acceptance! Is there anything I can do? I can't find a phone number to be able to talk to an actual live person at Experian or Equifax. I keep getting automated systems!
On 8/2/2005, "Bobo Majors"
All I can say is to call or contact the FTC and Better Bussiness Bureau for complete answers to this common credit delima. One charges off, another trys to collect and both report negative thus creating a double jeopardy of sorts.
I would hope one could only be reported by law but cannot give any legal advice on this matter. I'm just a guy who had bad credit and told my story and will tell yours also. I will say this is the most common credit question for credit help I hear day in and day out. Can they do that? They definately did and we should all pay our bills if they are ours under reasonable man circumstances.
Ok, I appreciate your help. First I'm going to try and contact these people again and try to come to an agreement with them on a settlement price and upon payment of that ask them to physically delete these items off of my credit (the 2 they reported to). If they refuse, I'm just not going to pay immediately and seek further assistance somehow... It just doesn't seem like this can be legal.
lex law might help but they cost 79 to sign and 39 a month thats not much if they can remedy these kinds of afflictions remember to keep copies if they do delete so that no following actions can be
reported o your credit score.

How long can a company use my credit app for inquiries
Quoting Real Person>:
Hi,
I found your email address on your website and had some questions I needed answers for. Thanks in advance...Peace...
First:
I recently pulled my credit reports and noticed that a company Whom I had a car loan with, which was then paid off in a transfer to another company, and the car loan has been paid off since 1994, inquired into my credit file in January 2005. Is this legal given that I have a Opt-out agreement in effect and I have sent letters to the direct marketing association as well. Do they have the right to inquire into my report and cause my score to lowered without my permission on a closed paid as agreed account? If not how can a handle this a) stop them and any other old close dout creditor from requesting my report or block the credit agencies from giving it out without my approval and gain back the point I have lost on my score because of it.
Secondly:
Another company that is a closed acocunt paid in full and in good standing, and was paid off in 2003 is still updating the last date of activity for that
account so it seems like the account is open when it is not. It shows a last activity date of 2005 and if was closed in April of 2003. Is this illegal and if so, how can I get the companies and credit agencies to acknowledge the true last dates of activities for this and any other account.
Third:

How can I write a letter to a credit that informs them to take a specific action-i.e. stop inquiring about my credit report after my acocunt has been paid in full and closed by me, etc. without them changing the last date of activity...

Thats a mouthful and very difficult to answer.
1. No they should not be able to pull your credit back up over and over if you
paid them well. If you have skipped town sometimes creditors can legally use your consent to look and see if you have new entries that mat make it easier to find a skipped town and owes me money person.
2. Long standing issue I have answered a hundred times on my blog and by email. There is not much you can do other than close the account by paying if you owe and ask the item be shown paid in full on such and such date.
3. I do not think bureau will add these items unless you pay and I have never done what you are saying but I know the FTC says we can update and add for a fee. Read FTC laws page on my credit web.
4. Fraud alert. Get my free form on my webpage
Should I pay a settlement collection that is not reported on my credit report
Quoting "REAL PERSON"
You have a great website with great information regarding credit reports.
My question to you is: I have a repo that is reflected on my 3 credit reports. I have contacted the collection agency who is handling the account and have gotten a settlement amount in which I intend to pay. I first tried to contact the original creditor itself, as you suggest on your website, but they have advised me that they cannot handle the account due to a contract with the collection agency. My credit reports show that I owe GEAuto, the originating creditor, and not the collection company. How will this change my credit score when I do pay the amount off since it is not showing as a collection but it does show as a "Voluntarily surrendered/Never Late/Past Due 855?" Is it even worth paying the settlement amount to the collection agency or should I just wait the 2 more years for it to come off my reports which will be the 7 year timeline? My fiance and I are trying to obtain a construction loan to start building a house so that is why I need my score to go up.
Thanks

Subject: Re: CREDIT REPORT, NEED HELP
If we do not pay the collection company they will put it on your account in addition to the other charge off or whatever. So I would say pay them fast and ask that they not report it at all if you pay them. they should do that.

Father Son Merged credit report and sons bad credit.
Quoting R Person
Hi Bo,
At the current time, I am not concerned with my own credit or score. It's got to be excellent because I average 3-4 pre-approved credit card offers a week. I have ordered a free copy of both mine & husband's reports just recently, but not the fico scores.
The concern is my husband's account. My husband has never been late on any bill or credit card, ever. The problem is our 36 year old son has the same name and has terrible credit, and it keeps getting reported on my husband's account. Three times over the past 15 years, we have disputed all the incorrect items on his account, gotten it cleared up, and the credit card offers started coming in again (by the way-those are shredded, not applied for). Within 6 months to a year, it's back to the same way it was before. We have finally given up for the past 5-7 years since it seemed that no matter what we did, they would continue to get my son's reports back on my husband's credit.
We can't afford to order his credit report 3 or 4 times a year to keep track
of this, and actually, it gets rather tiring since it takes a minimum of 2 months with back and forth disputing to get something done properly. Is there anything that can be done to make them realize that the birthday/age/social security numbers are not the same and to stop putting reports on the wrong account?
Thanks.

Put a fraud alert on his account with contact info before and other credit is extended. These alerts usually only last about 1 year so you will more than likey have to do it each year. After a few years someone usually gets the point.

Errors on my credit report. Click here for my report.
Quoting Real Person.com>:
Hello Bo, I am vijay, I live in DC and I am an engineer, going about to get some information cleaned from my report - that I never knew existed.
Also any suggestions on what to do to keep them / organization from doing the same stuff ever again.
Sincerely

Thanks again Bo.
When I got my report I had 6 rated at - R and U9, needless to say I was
shocked, and moved very quickly.
I got 4 of them resolved; the Companies have all sent me either apology
letters or correcting the error and sending me a report to that effect.
However, I am facing a problem with ATT cable and ATT wireless; both are
now owned by other companies like Comcast cable and Cingular Wireless. I
have paperwork, for the both of them, but it has been impossible to get
any form of resolution because I get shuffled back and forth between the
credit agency and the companies. Any clues on that.
- I wrote them numerous emails, called them so many times, the facts in
their system even reflect my statement, but they simply refuse to issue
me a letter or a point of contact to deal with.
What can I do in this situation?

Free Credit Reports, Free Credit Scores, New FTC law
Everyone in the USA is entitled to one free credit report per year from all the consumer reporting agencies. If I desire more or want it fast I can get a report in a bunch of ways.
1 I can mail this letter to the bureaus and get one by mail in about 14 - 30 days. The FTC advocates mail as mail is more secure.
2 Free credit report usually means I buy a credit moitoring service for about 80.00 dollars and get a free report and some live help to questions. If I cancel this service before 30 days I get to keep the report free. So buy monitoring and get a 1 bureau report free.
3 Buy a one bureau report straight out for about 9.50 and add another 5 to upgrade and get a score.
4 Free credit score when I buy the comprehensive 3 bureau report I get a free credit score to go with it. About 35.00
So I can snail mail once per year for Free. 14 - 30 DAYS
I can buy monitoring cancel within 30 days and keep a free credit report. NOW
I can buy one report and upgrade to a score for about 15.00 NOW
I can buy a comprehensive 3 bureau report and get a free credit score. NOW
Deletion letter, pay bills, collections, Pay it now help my score?
Hi Bo,
Thanks for the information on your great site. I was wondering if you get a chance to give me your opinion about this problem. I have 2 co. listed on my credit report under collections for the same bill which I am disputing with the original vendor. Both co no longer are contracted by the vendor to try and collect the bill. What is the best way to get them off of my credit report asap? Should I contact the collection agency myself and ask for a letter or should I just go through the 30 day
dispute process or both? Also, I purchased 1 report directly from Equifax, will a dispute online work ro do I need to send them a letter?
Thanks so much for any help and ideas you can provide. Feel free to post it.
Sincerely

I'd dispute them first and list the non contractor for original bill as reason for removal. It's like they are ot of business. They should not be allowed to keep your records if not under contract. Which would mean the account should be removed. At the very least they ae duplicates and one should go. I advocate mail as piece of mind mean more to me than getting a piece of them.
Just mail sit back and don;t get frustrated or waste time
Thanks Bob for the personal reply and taking the time to share your wealth. Not sure what this means "I advocate mail as piece of mind mean more to me than getting a piece of them." Also does disputing online not work as well as hard copy mail? Since I am in a hurry to boost my score I thought it might work best. Which is also why I was going to contact the contractor to optain a deletion letter.

Redate, Fair credit reporting, collections, seven years limit
Quoting REAL PERSON>:
Hello Bo,
My name is REAL PERSON, I am 26 years old and I need some help. I have heard so many different things out there that conflict and I am hoping you can help shed some light on them for me. First, I have two items on my credit that I never paid back when I was 18 years old. I was having some trouble then and I didn't ever pay them. I was told at the time it would take 7 years for those items to come off my record. It has been longer than that and the items continue to be redated and updated by the creditors. OR they are sold to another one and the date moves up again. My question is in regards to the 7 year rule. Is the seven year rule in reference to when the account was first reported as being negative? is it when its sold and re-established by another company? or does it start from the date that you pay it? I would like more information, like a reference site, or somewhere where I can find the actual letter of the law.
If you can help I would appreciate it!!!
Warmest Regards,
REAL PERSON
Real Person:
This is the most dangerous game played by creditors along with bureaus who alow this practice. Selling the debt to another company is the most common form of redating I know. 7 Years start from the date of last activity on each account. So the first account should come off for sure. The letter of the law is found here and the letter favors #1 creditors, #2 bureaus, #3 smart people who have been defrauded and the like, and #4 people who don't pay there bills on time occaisionally, or had an illness or problem with a job and probably don't have a computer to see the law. The last (#4) being an oxymoron. These people need help. Almost all people have no idea what to do about bad credit and how the process works. A person disputes a credit entry to the bureaus and they in turn contact the creditors to verify the good or bad credit. The creditor then must respond within the 30 days of the BUREAUS request not yours either verifying or denying the credit entry. If they do not respong within 30 days the item should be removed.
Now if you read that ftc thing, you will notice nothing about collection redating. And you will not unless the ACLU or an enormous number of consumers get togther to make a change.
What is happeing to you is wrong and should be outlawed. But I don't think there is a letter of the law you can stand on.

Collection, redating, paid in full, increase score
Really the best way to get paid as agreed and in full is by negotiating with the original creditor in the first place. Once you dispute then everything becomes sort of final. Will it help your score? Probably not very much. It still shows as a collection, but you did get the money out of the past due column. Another note that might hurt is the item might have been redated and now your seven years to fall off starts now, and the 2 years till diminished negative or positive effect to your score.
The name stuff I would dispute again and possibly place a fraud alert on my file. Your name could have been misspelled by accident or someone may have been trying to open credit with your name and misspelled it. Credit reports have become one of the most important part of a persons life and should be guarded like a child.

Hi Bo,
I was reading your site and found that you were very informative and helpful in a "real person" manner. I was hoping you could answer my questions or lead in the right direction. I recently settled with a collection agency for an account that was probably charged off, been about 2 years to the date of my last payment. The agency had retained a law firm (or the agency was a law firm and I was issued a summons. Not wanting to go to court, I settled with them for an amount and have received a "Paid In Full" letter, as well a "Stipulation of Settlement" that was filed with the court (I am assuming with that being filed with the court, I do not have to appear). Now I would like to update and improve my credit score but I am not sure how to approach the credit bureaus. I am not sure what to include in my letter, the type of response, and response time I should be expecting. Also, the "Paid In Full"
letter is pretty generic although it has a legal header there is no signature, is that OK? Do I need to include the "Stipulation of Settlement" or just the "Paid In Full"? Can I request that that item now be deleted since it is completely paid? I am so lost. Sorry for the long email. Your help is truly appreciated.

Unauthorized credit report inquiries
Someone has been accessing my credit report on line and viewing it without my consent. A family member--told me outright! My question: does Equifax, Experian and Trans Union keep track of how many times it sends out an individuals report and to whos mailbox it it received in? Other than my bank mortgage person who pulled my report recently which I gave verbal permission too---this invasion of privacy, if in fact this family member did pull my report, has got to stop. These should show up as inquiries unless they are doing it online which is unlikely in that online report require a matching credit card to go with the social and personal info.

Unauthorized Credit Card use and collection redating
Sounds to me like one big mess that you decided to take credit for when you should not have. Credit cards are supposed to be signed on the back and verified buy merchandisers. But as we all well know we can go to the gas station or even Wal-Mart and just SWIPE that card and off we go. the credit card issuer is not at fault and done all they can considering you will not file on this man.
If it has been a long time since DATE OF LAST ACTIVITY i.e. payments made by you. Then the item should fall off in 7 years. If the collection agency is re dating the file, you might go to the BBB and file on them to stop the harassments.

Subject: please help
I have read your info with enthusiasm and thank you for being kind enough to do this. Wanted you to know this right away. I do have a problem that I need some coaching on. Firstly, sir, I am not a deadbeat. I take my responsibilities very seriously and honor them. My credit report reflects that I paid off debts of over $2,000.00 and over $3,000.00 in one fell swoop and in full. They were my sebts and I wanted them gone. In late 1998 or early 1999 (I can no longer recall), a farmhand working for me, used my card (I always stupidly left it lying on my kitchen counter so it was handy when supplies came) used it without my permission. He was not an authorized user on the card and I can't believe that VISA allowed him to make purchases with my card without verifying same, but they did. The stores he ordered from allowed him to do this also. When I contacted VISA to work this out: offering to return the merchandise and asking what proof they needed of return and taking them to task for allowing this, they refused to help me stating that if I would not pursue fraud charges against the man they were not interested in helping me. I would not do that as the man had a family, he did a stupid thing and I believe that human beings deserve 2nd chances. The man offered to pay Visa if they would give him the credit for doing so. They refused. I refused to pay them for something I did not do. The companies were willing to take back the merchandise but as Visa would not credit my account, this would do me no good. I was in a hole. I still have the merchandise, never used in the original cartons. I tried to sell it to make the money to pay them and was never successful. Then the company went out of business. To finally shorten this letter, my question is this, bad debts come off in 7 years from date of last activity. What does that mean exactly? I am waiting for this to come off my record. I have disputed it 'til I'm blue in the face to no avail. Of course it went to collection a long long time ago and I have handled their insults and harassment for all these years. I have offered them the merchandise. I am now just waiting them out. But last activity bothers me since when I read the credit report they are always showing some activity on the account that is recently dated. Does this ever stop. Way back when this 1st happened I put a dispute form into my file with all the letters and documentation between me and Visa and I update the dispute frequently. Is this ever ever ever going to be off my record? I don't want to burden you, sir, but I am ill with cancer and in a fight for my life right now. I just can't keep fighting and I do not want this mark on my record. I use credit very sparingly and respectfully and this really bothers me. Can you please advise? I will be very grateful. Dear Bo,
I have hired someone to do the bull crap for me. Lexington Law. Much easier than me doing it myself. But i wanted to let you know that you are right.
I tried it the other way. Took to long. Had a BK back in 98'. And well to make a long story short, everything was showing up on my credit under the BK as open and still oweing. Since I have hired this company. 1/2 of the crap under the Bk have been totally illimated. I went from a 425 beacon score 4 months ago, to a 650 beacon score now.
The best thing is that when I go to buy a car now. I get told look at anything you want "No problem" Instead of the "you can look , but not drive" And the "Gee i will be right back" And never see the guy again. Anyway nice to see someone out there helping people to get their life together. Have a nice night.

Quoting REAL PERSON
Hi Bo, I was reading your site and found that you were very informative and helpful in a "real person" manner. I was hoping you could answer my questions or lead in the right direction. I recently settled with a collection agency for an account that was probably charged off, been about 2 years to the date of my last payment. The agency had retained a law firm (or the agency was a
law firm) and I was issued a summons. Also, the "Paid In
Full" letter is pretty generic although it has a legal header there is no signature, is that OK? Do I need to include the "Stipulation of Settlement" or just the "Paid In Full"? Can I request that that item now be deleted since it is completely paid? I am so lost. Sorry for the long email. Your help is truly appreciated.
Sincerely,

My first thought is you have a legal item on your credit report which means 10 years.
Do you have your report. If not get one NOW!
I would dispute the item and marked paid in full after i tried to dispute it as not mine.
Should take about 14 - 30 days for response.

Debt Management and Credit Scores

Hi Bo,
For the past 4 years, I have been enrolled in a debt management program. I have been very successful in paying off most of my creditors. Actually, I started out w/ 7 creditors and I am not down to 2 that still have balances. Do I need to do anything (such as fill out a dispute form or contact the creditors directly) so that most of the creditors can take off the bad credit from my credit score? I am in desperate need of improving my score. Any advice that you can offer will be great.
Thanks. Real Person

My best advice would be to
1 open up some new reportable accounts and pay well

2 dispute all the bad debt and hope for the best
3 if they do not come off, add a comment to each with a letter

Saw your web page. Cant get anyone at Experion, maybe you can shed light on one or two questions for me.
a) i'm showing one or two 30 and 60 day late payments from 1995 and/or 1996 ...I thought these were supposed to "fall off" after 7 years?
b) how come when you order a credit/fico report from Experion it says one thing, 687 for example, but when my bank gets a compiled report which includes an Experion score generated the very same day, it says 625 for example!
I can't find any way to contact Experion to ask them these general questions!
Thx in advance!

a The lates should come off if the date of last activity shows 95 / 96. Start dates are in different columns than last activity date.
b Experian Trans Union Equifax all have different data. My company subscribes to Equifax only. If you have multiple credit streams there will be a different score since they all use one of the 3 but rarely all. The scores measure in simliar ways but are all branded. Just like Chevy Dodge Ford trucks all call they're 4 door trucks a different name even though they do the same thing.

Business and Personal credit
Quoting Real Person
Hi Bo,
I have read through you blog and you seem like "the guy" to talk to
regarding my situation. I am a small business owner. I just started my new company one month ago. I recently checked my credit report and found I have a POOR Beacon Score of 563 through Experian. I need help establishing my business credit as well
as fixing my POOR personal credit.
This is my own fault as I did not take my credit seriously and for years relied on cash payments for everything. I had no idea how much this would hurt me down the road and figured I didn't need credit. This comes from being raised by a "creditaphobic". My family didn't believe in credit. It was taboo to even talk about it in my household when I was growing up. This stemmed from my fathers experience when his mother ran up major bills on her Sears Card when they first came out some 10,000 years ago. So needless to say I didn't take it seriously enough to follow through with establishing a good credit record. This was foolish on my part and I am paying for it now.
Recently I have had a major change of heart and realization that credit is something you need. When you sign that paper, that is your word. Even more than your word it is in writing and might as well be written in blood. It is what you say you are and tells others if you are dependable and that they can trust you. This realization I hope has not come too late and I hope and pray I can fix what took me years to mess up.
Back to my new corporation. I started it on April 19th 2005. I filed all paperwork and now am the proud owner of a few dozen sheets of paper with some really cool sounding legal language on it which says I own a new Florida for profit corporation. YAY! I know it really does mean something, and I am proud to own my own corporation. But creditors and banks don't look at it that way, and surely don't share in my enthusiasm.
Every bank and creditor I talk to says I need to give them my personal information to apply for a business credit card under the corporate name. What can I do to get a business credit card, or establish credit for my new corporation? Is it possible to apply for and receive a business credit card "without" using my personal credit score? What suggestions do you have to establish my business credit and fix my personal credit at the same time? What Beacon score would you suggest to apply for a credit card for business or personal, and would it be wise to apply for credit at this juncture? I have 3 inquiries on my credit for the year unfortunately and don't know where they came from and don't want anymore. Would it be a good idea to just apply for as many credit cards as possible at one time and play the numbers game or would I be wasting my time and lowering my score for no reason?
I would like to use the business credit cards for start up capitol and to purchase initial inventory and equipment. If you know of anything that might help I would be greatly appreciative. I have checked the SBA, FTC, BBB, FirstGov.com, and a myriad of other sites for any information regarding what kind of beacon score I need for a credit card of any type but have found very little information regarding actual scores needed. I know all cards are not created equal and requirements vary by creditor, but there has got to be a general rule of thumb here. What's the minimum Beacon score I should have when applying for an unsecured credit card? Am I wasting my time with a score of 563?
Wow! I know that a lot of questions but I have never done this before and never had a credit card in my life. The closest thing is my Debit Card through my bank and credit union. I have 4 bank accounts with 1 bank and 1 credit union. 2 business accounts and 2 personal account with 3 Debit Cards.
I have not applied for any cards yet and don't want the inquiries on my credit report. I don't even know if inquiries would hurt me at this point.
Help please...
Regards,
REAL PERSON
To be a corporation that relies on it's own merit it has to be at least three years old. So you have to rely on your personal credit until that days comes. When that day does come try to transfer everything to the corporation to isolate yourself from finacial ruin.
I would max out whatever i had until that day. Asssuming you will make. If you don't. It would probably be wise to file BK as you will not be able to repay without a business. I know this from from best friends activity in GA.

Subject: Consoladated Accounts
Bo,
I used student loans to pay for my college education and my lenders differed from one semester to the next. Upon graduating, I consoladated my student loans into one payment. Consequently my credit report consist of 10 to 15 pages of transferred/consoladated student loans. Creditors have consistently brought this up during purchases and this has really cast a negative outlook on my credit report. Is it lawful for these transferred/consoladated accounts to remain on my credit report. I feel that these are pointless entries and should not be on my credit report.
RLP
If you did transfer / consolidate loans several times or even once, yes this is legal. The more accurate assumption I would make is that, all you have are loans that have been deferred over and over and no real person credit and at some point you will have to pay the piper. Many lenders veiw these strung out loans as a possible future reason for you to bank rupt on them. So those loans make you a higher risk. The best way to compensate for this, would be a huge salary and long term job time.

Subject: Charged Off .... But not Really
Hi Bo:
I came across your blog as I am suffering from a headache on my credit report. I have a negative item on my report from a creditor and I don't believe it should be on there. TransUnion researched it and deleted it, but Experian will not and I am unable to get credit because of it. The scenario is this:
3 yrs ago, I had a past due balance with a cell phone company. I received a letter from this creditor saying that I had to pay the balance within 30-45 days or it would be forwarded to a collection agency and reported to the credit bureaus. I paid the amount in 27 days. I have proof of payment. However, on my credit report, this item is listed as negative and it says that it was charged/written off.
Do I have a case to make for getting this off my report since I paid it within the timeframe my creditor gave me? Should this be a negative item since it was paid?
Thanks for your help!
~~Mad at Experian
It would be better to be mad at the phone company. Go to them but do it in a somber tone. Explain how you are trying to buy a home and this one item is holding you back. Explain you are certain it is a mistake and show a canceled check or payment stub for proof. Ask them for a letter saying account paid in full and as agreeded and mail that in. If Experian refuses to take it off it is soley due to the phone company verifying the account as being late and past due.
Good Luck and get that letter.

The only thing they can do is add an attachment to each included in bk item which will not help your score
You might dispute some hoping for total removal first. Say it is not your account. If the bureau doesn't remove it, send another dispute with attchments to each item on bk to say involved in Bk.

Hello. My question is if an account is in the “charge off” status, will it be removed in 7 years even if the balance is not paid off
Yes it will. Sort of like the statute of limitations. The thing to look for is when was the last activity date on the account. 7 years start from date of last activity.

I only have four active accounts on my credit 2 credit cards a car and a furniture bill. My car and furniture bill will be paid off in a month or so, the only thing I will have is the two credit cards. By not opening up any more accounts do u think my credit score will go up with just those two account. I also am paying of some old accounts collections with balances is this a goioid idea?
When I answer questions about credit I really must admit I am in the dark. I haven't seen a persons credit in most cases. I haven't taken a credit application to help me understand your positon in life, and the information I get is limited.
Make sure you have paid at least 12 months on any credit so it will be rated. Yes these will help your score.
"Old collection" sounds like a problem but not one to avoid. Yes pay them off, unless they are 5 years or older, thus redating the collection. EXCEPTION your lender ask, or the credit / collection agency promises to take the collection / slow pay off or, mark as paid in full and as agreeded.

Your website is great, and very enlightening. I have already disputed some things on my credit report, and I am just waiting to hear. My wife and I are hoping to buy our first home.. My Equifax beacon is 651, Experian 642, and TransUnion 622. Will I be able to get a loan for a home with these scores? I would appreciate some advice on what to do. Thanks, R P
realperson@bellsouth.net
Home loans are much easier to qualify for if you have sufficent downpayment. 10 - 20 percent. And a 640+ beacon score. So I would suppose you can buy whatever you wish as long as you have a downpayent. Even if your score is below the 640 range downpayment, job time, local realatives and other factors can get you financed. There are almost endless ways to buy home with endless lenders. Ther are many people in your area right now who own homes and will owner finance for you with reasonable terms even if a first rate mortgage compny disqualifies you due to the one 622. If they do, I would work on that one. Pay down to 80% of high credit limit on all your accounts. Dispute a few things. you can raise that one 18 points I'm sure.
Good Luck

By all means pay in full. Your credit is too good to settlement anything if there is any way to pay. How much money are we talking?

Depends on your income and ability not to continue debting
If your debt becomes more than 45% against income, meaning monthly income minus monthly debt on car, home / rent, credit cards and any other revoling debt, then you are considered insolvent by most lenders.
In this instance i would say settle.

Pay Settlement or In Full for better credit?

Subject: Settlement or payment in full
Hi Bo,
I was browsing the internet for a good information on how to do it yourself credit repair and found your website very very helpful and no bull (....).
I have beginners questions for you. I'm trying to settle one of my account, and it's currently with the collection agency as well. The collection agency got a settle plan which take 30% off the full amount. It's $ 101.00 so I would only pay around $75
Do I need to pay the full amount for a good standing or pay the settlement plan?
Does it make any difference?
Thanks in advance,
Real Person
Unless both places, the collection agency and orignal creditor both agree to "account paid in full and as agreeded" your credit will not be helped much other than getting the balance out of the past due column. The MAJOR problem is it will show up as a collection AND a late or settled account on the original creditor and the accounts' date of last activity will show todays date thus making 7 years (removal) or 2 years (diminished effect) start now.
I would try for both and settle for nothing less than one entry on this account, the collection or original creditor.
Make sure one goes away totally and the other shows paid at the very least. Co-operation may prove difficult but go for it in a humble manner.
So pay the settlement or play offense and try for total removal by agreement to pay full or extra. Sounds to me though that the answer to your question is ...... Not much difference if any at all.
Good Luck

Hi Bo,
I was reading your website and it is choc full of info!
I have 2 delinquencies on my credit report for late payment over 30 days. I called the credit card company and they told me that they could do nothing to remove the delinquencies from my credit unless it was their error. Do I have any other options or am I stuck waiting 7 years?
Another question if I pay my credit card debt down to below 25-30% of their limits will that bring up my credit score significantly? If so could you estimate?
Thanks for your website and all of your help!
Sincerely,
R Person
It sounds as if the answer would be no to the first question. You have tried to no avail unless you have a check receipt from your bank before the 30 days past due date. You are entitled by law to dispute this entry through the bureaus. The answer will probably be the same. Try to get 2 years behind you and ask for help then. Do not close your account and pay them well and your score will go up anyway.
If you pay down any account to below the 80% against you highest allowed limit on the account, it will help your score and sometimes significantly. So do it!

I am clearing up my debt and have been offered settlements. One company is owed $1000 but offered two settlements. One for $700 which will be marked paid in full, while the second settlement was for $500 which will be marked settled.
Is there any real difference as far as my credit report is concerned.
SJ
To help your score, your credit report has to show paid as agreeded with no late payments AND in full. So the answer would be no and possibly a small yes. These will not help your score if you have entries in the overdue column. Paying in full will clear this column and it will help your score some. The overiding factor on scores are paid as agreeded and in full. Any late payments or settlemnts will still show you were late at some point in time, thus lowering your score. The up side is to pay every bill you have no matter what your score is but try to use payment as a lever to have thing marked paid as agreeded and in full. The back side, if you pay now is, todays date will show as the latest activity which is where the seven years will start. After 2 years, good or bad credit has diminshed relevance on scores. So for at least 2 years your payment will have more effect in the negative, due to recent activity. Get a gas card by sending them money with your application and overide the recent negative, with recent positive credit.
Good luck

Thanks for your info. Your home page is very useful. 4 months ago I filed BK-7. Last month I received my credit report and many of the accounts have not been updated and the ones that were updated have a pay status of "Unrated". I can't find a definition for "Unrated" and how does that affect my score. I'm not looking for a 720 score, but I would like to see some improvement.
Thanks,

Unrated means it is not an account established at least 12 months ago. So the account is less than 12 months old.......or some times they go unrated when they are older than 2 years from date of last activity.

All free credit reports are a result of the customer buying something. In almost all cases, it is credit monitoring for 79 range. The trick is to cancel before 30 days elapse and wala, free report and score.
Most instances it is only one report from one bureau
But you do get a score and most scores and credit are close at all three. If you cancel in less than 30days it is totally free. FREE
People west of the Missippi can get one in about 30 days free with no score if they write the bureaus by hand and snail mail it to them. Or on wlefare loooking for a job and all thats on my website.
I like to just pay the 34.95 and get all three bureaus and a score and be done. NOW!!!!! HERE!!!!! LETS GET ER DONE!!!!!
