apartment is taking me collections. is there anyway I could dispute this?

My X apartment is taking me collections. I had to move out of that apartment because of all kind of leaking that was going on. I had water come in from the apartment on the side of me. It leaked into my bedroom, then about 1 or 2 weeks later I had a leak in my bathroom vent from the upstairs apartment. So I left that apartment as soon as I could. About a month later I get a letter in the mail telling me I owe them $200.00.
They charged me all kinds of cleaning fees! I cleaned that apartment as best I could with all that went on. I think they are just trying to get some money back. I would like to know if there is anyway I could dispute this??

If you can help me in anyway it would be much appreciative.

Sounds to me like you should have taken pictures, documented calls to the landlord and protected your interest before hand and not after.
If you have any evidence please us it to your best ability. 200.00 is not a lot of money if your credit is good now. If your credit is bad it will not matter much. 200.00 could cause you a lot of interest in the future and it would be better to pay than loose good credit. If the item is on your report now it is probably too late to help you and payment will not help your score.

So Have you checked your credit lately?
Is your credit 650 + ?
Is the 200.00 on your credit already?
If your score is 650+, and the item is not on your credit now>>>..
PAY IT FAST.

If they mark it as paid but do not take it off it will not help your score at all.
Matter of a fact it might hurt your score.
Redated to 2005 marked as paid on that date or "date of last activity".
So in 2008 it falls off completely
Right now it pobably has little effect on your credit if you have current credit working right now. The last 2 years of credit is more heavily weighted.
I would make a copy of my report now. Then tell the creditor it is of no help to pay the balance unless the entry is totally removed not just marked as paid.
So at this time you feel it is in your best interest to leave it like it is unless they are willing to do so. Then explain the you have made a copy of your report with a date and if any changes are made or any re-dating, inquiries or other unlawful activity occurs, you will be forced to contact the ftc about your explicit rights under the fair credit reporting act and a possible law suit may arrise in conection with any such activity. I am not trying to be rude but just have to do what is best for me and I have rights under the fcra. Please do not call me anymore or use any unlawful practices to collect on this very old collection.

Sounds like they are already out of bounds on the collection laws stated in the FCRA. Collections normally occur withing a 6 months time frame. At this point the creditor has already tried to collect and sell the debt for pennies on the dollar. The creditor takes a tax deduction from the IRS for the difference and the collection company keeps whatever they can collect on. That's how collection companies make money. So if they do not get your money they do not
get paid and go out of business which is good for you. Then you could dispute the file and have it removed since they cannot respond. So keep the phone number and check every 6 months or so from a pay phone or something.
In this case it sounds as if the file is very old and has been written off totally by the creditor in the first place. If this is so they collection company could afford to agree to a 1/4 payment because they have no investment. If this is the case collection might be illegal due to multiple collection on a written off debt to the IRS.
I bet the guy screaming was not even a lawyer. What do you want to bet. Tell us anything to get us to pay.
To be quite honest I paid every debt I ever accrued and feel everyone should pay ALL true debts. However if I was this far down the road I would not pay knowing what I know now. I paid an electric bill I owed 2 years late and it was redated. Same for another debt. But that was years ago before I got into this website on accident to help people like me. I found it very difficult to find information on the internet back then for credit help with the bureaus and even harder to talk to a real person.

how much will my score rise if I have a collection removed

Hi, and thank you so much for your helpful information. One thing I was not able to find though was how much will my score rise if I have a collection removed? I know I have succeeded in doing the impossible but I did it, not paid in full, not evened, REMOVED. My score is now 643 with the collection on there. I don't want to do another as it may lower it more. So just ball park how much does a collection lower your score? 20, 30, 80? Besides that I never
miss a payment my credit cards are high right now so I am paying those down quickly. I have worked really, really hard on my credit the past few years and this collection from a hospital for $44 from 6 years ago popped up but now it's gone.

if the collection is within the 2 year margin I would venture a guess of 25 points. But no one knows for sure. It is sort of like the bcs rankings. I do know this, a collection has 2 negative effects on your credit. 1. it shows you have 100% balance against high credit on that account. 2. It shows you diidn 't pay a bill that was sent to you over a period of time. Normally collections only show up after numerous attempts to collect.

Another note. 44$ is not a whole lot of money and if a small collection like that is over 2 years old either make sure it gets deleted fully or do not pay it. It is far better to have the collection 2 years old than paid and recent.

You must have had major problems in resolving credit reporting issues to help other people resolve theirs! My question is this: after filing bankruptcy and getting a copy of the credit report, I disputed the accounts that were included in the bankruptcy because the report stated there was still an account balance, past due amount and that the accounts were still open. I sent a copy of the bankruptcy along with the dispute forms and when I received the response from the credit bureau they had not changed anything.
Can they by law leave these accounts open with balances and past due amounts showing on the report?

I think they have to show account included in bk and zip the balance due part. Most times bureaus have to be promted. Well I should say always have to be prompted. No prompt no action. bureaus are in the data business. But yes most all credit items will show negative for 7-10 years even with the bk. Bankrupcies resolve debt issues not credit issues. 2 different issues with the same subject.

Well John this is a perfect case for some one to step up and do something THATS RIGHT. They are correct in that you were late as you clearly state. I would probably have asked for relief from the start. But t is never too late. I would call each creditor.

I would say not often and it makes bureaus mad.
Try around this time of year and you have a better chance.
More than likely they will send you back a frivilous dispute request letter for duplication of efforts

I would try the creditors a little if your dispute does not turn out
and write down everything you do and who you talk to and what happened on what day.

Hit them with all you can using lawyer like tones and facts.
Explain your rights under the fcra
Keep checking your credit online
The creditor might make a mistake and check your credit which is unlawful.

I am sure that they can not produce my signature on the collection as my ex husband signed my name.

Sounds to me like you have a valid legal arguement by the FCRA
I would send them a letter stating I believe rights have been violated by the law and wish to see my signature on any documents they have in my name. In addition I would state if they cannot provide this information To elimnate the collection or face the possibility of suit and reporting to the FTc. If you find the signature on the documents to be foorged you plan to follow all your legal avenues as far as forgery and illegal collections on a forgery. Send the mail with confirmation recipt requested and keep a copy of wht you sent them.
Explain you are not trying to be rude but just trying to make sure no one has violated your rights by the Fair Credit Reporting Act governed by the FTC. They must produce a copy of the signature or thus be sublect to FTC laws. Rememeber to not be overly demanding, but to just state the facts and ask for all required documents by law.

How long do credit files stay on my record? How long does your credit report reflect your bad credit?
7 years for bad credit, late payments, collections, charge off's. Lawsuits and judgments 10 years or until the statute of limitations runs out in the state. 3 years for inquiries. Diminished effect on my credit score takes place at 2 years out. Good or bad! If you have not used credit in 2 years you score will be gone. Must have used credit within the last 2 years.

3 bureau bureaus credit score & report reports

none of that sounds right at all. On disputes they either come off or they do not. If they do it helps. If they con't it stays the same. Disputing never really hurts. A permanent comment about making payments or some sort of thing might hurt. Above 80% on high credit limite might hurt. Sometimes a creditor may lower your limit as they get paid to make it harder for you to get out of credit delerium. But none of that makes sense other than scores can rnage 100 points from bureau to bureau if some items or only on one bureaus report.

It would be illegal to inquire on you if they do not have your signature. I would venture an educated guess that the calvary account was sold to calvary by some other creditor "for 30 cents on a doolar or some figure" and that creditor is the one that is now gone. I would suppose you will be finding this collection on your credit pretty soon should you continue to not respond. Is it legal? I do not know. All I know is it happens all the time. Search for it on my blog. I bet this very question is in there 10 times. I would pay them if it was my credit entry "regardless" due to honesty. If I owe it, I pay it. But I make sure they do not put it on my credit if I do. If the amount is too much just duck and hope fopr the best. What are the laws? I would call the BBB. Or consult with the FTC. That is all I know.

She was saying "that" in reference to all scores but probably advocating fico because of her affiliation. All scores fico, emperica, beacon are the most important part of your credit not just a what is on your credit report. Many banks look at these scores only. So they are all very important depending on which one a credior uses. We use beacon scores but sometimes send stuff to banks for approval and they use the trans union fico. So it totally depends.

Lexington law and my score has raised 100 points

The only way to convince a creditor who verifys late payments is directly with written proof or a cancelled check. One must show it was the creditors mistake and not yours for being late.

I had ten-thousand dollars in cash and couldn't get approved for a twenty-thousand dollar loan

I am very scared to investigate my credit score

This "scary" issue faces almost everyone I know who has intelligence. I am afraid to look at my bank account most days because my wife and I are such disasters. We cannot manage money worth a dern and overdraft almost monthly although our overdraft protection bails us out most times. But the same issue you are talking about kept me from trying to buy a house in 1994 and you can read my story about what I found out. The truth is your credit is real and you should know what it says. You should know facts about credit. Late payments are not reported as such unless they are 30 days old. Many people think paying 15 days late messes up your credit. NOPE. You mention 1990. Heck that is 15 years old it should be gone by now. Little things like that scare people.
The one true credit god is your friend not your enemy unless you never feed it and talk to it. Check your credit NOW. Get a score. there are 3 bureaus check all 3 right now. No one is going to hurt you. The only problemm you may face is seeing damage you already dread, or finding something incorrect which you CAN FIX. Oh my gosh. Check your credit every year and make it a habit like brushing your teeth. Credit is your friend.

this mysterious creditor is nameless. I have no way to contact them

Good Morning,
I recently decided to use my car as collateral for a consolidation loan. I thought my credit score wasl around 640, when I heard 605 I was shocked. The bank manager let me know it appeared to be from a medical bill last fall. I have insurance. I have no idea where it came from or why. The main problem is this mysterious creditor is nameless, therefore I have no way to contact them or give them my insurance information. The only thing available is three numbers and a bunch of stars. 491***, its only listed for 1 month then nothing. Does that mean, (seems obvious the more I talk about it), that my credit suffers because they either payed the bill late or were never notified of one? Thats not right.

Next I would like to know how negative the effect may be on my credit if I do receive a consolidation loan with the title of my car? Its still worth $12,000, has 50,000 miles of high quality warranty remaining, looks and runs great and is fun to drive. Plus it is payed for and its mine. I really don't want to sell it if I don't have too.
I always figure theres a brighter day somewhere in the future.

Collection under a different account & five year newer date

Dear Bo,
You have an awesome site!

What if I have a collection account that has been paid, and has been updated as such on my report, but a credit card company has bought the original account (before it was paid), and reopened it under a different account and five year newer date.

Consumers would argue inherent flaws cheating
Creditors would arugue needed relif from deadbeat consumers.

Whos is right
how do we find out
and if the later how can consumers change it
if the former what legal grounds stand behind consmers change it

if the later how can creditors ever make a business model work
if the later quite the same as the former.

Ask the BBB, The FTC, and Bo is guess. Bo cannot give you a perfect answer to this common question and reporting technique.

My personal opinion is the 7 year rule should stand under all conditions other than a consumer who makes payments or something which could be contrued 2 ways. date of last activity "last payments" being the start date for 7. OR being able to get the mark removed if you pay as agreed on collections or any account.

I paid ANOTHER company and they did NOTHING can a bankruptcy be removed?

you might try to dispute all the bad records as they get older
2-5 years and some companies go out of business
some purge old records
some just move and can not be contacted
keep trying on the dispute end over time
you are not your credit or bank account
you are a living creature and have value
do not get too depressed over money

I corrected mistakes but my credit score remained the same

I contacted an attorney to solve credit errors

I have three creditors. IC Systems who I paid off in 10/2002 although I paid them off in 10/2002 the company never showed up on my credit report until 3/2003 and 6/2005. When I disputed the account on Equifax they removed it stating they had the wrong
social security number, which was a lie. I've been going back and forth with them to update the dates on my credit report, they refuse and my lawyer (lack thereof) has said it's pointless to dispute it through him all I asked him to do was prepare a letter. How can I ensure that they update the dates on my credit report to reflect accurate reporting?
First Premier Bank, I settled for a lesser amount and yet they won't update the current status to just Settled Account and leave the other junk off, is there a way I can get them to do this, again my lawyer refused.
I read on the internet how lawyers can settle accounts for their removal, is this possible, have you heard about this and is there literature on things like this happening?

i would say the lawyer handles only law issues no credit issues
in fact a consumer is the only rightful disputer

i will say that just becuase one files bankruptcy
settles and account
pays off a collection
does not mean they are entitled to have all the other real life credit problems taken off. If you did;nt pay a credit card. they charged you to collection and then you settled. It does not mean the bill did not get late or that it was not sent to collections. I think many people believe once they pay that all past negatives go away. It's kind of like the thing I here every day. I have great credit. Sure you paid them off but look how many times you were late. There is way more than just paying someone off to good credit.

I not saying any of this applys to you. These are only things I see day in and day out.

the payment was there on time and it didnt get posted

To be more complete I would have to adivise people with collections to do more than make payments on collections and THEN ask for removal. Catch collections fast and pay them in one lump sum with penalties and ask for total removal if you complete the payment with a letter you can use to dispute the collection. Most collections only show up after repeated contacts. So when collection hit everyone knows this has been a total lack of payment after prolonged attempts to contact. Add that on top of making payments rather than lump sum. What really looks bad collection is Utilities (phone, eclectric, gas, water, rent) and previous creditors turned over to colections. Hospital stuff usually doesn't hurt as bad other than all people now that hospitals try to set up payments before they send items to colection.

But alas there is a rainbow. You have paid them off. You are making new strides with 2 open trade lines. Your score will follow positive feedback over time.
Hope the collection companies go out of buisiness later and you can dispute them. Always dispute unfamiliar accounts older than 4-5 years in hopes for removal. I assume your collections are not duplicates of another account reporting creditor who could not collect from you. If this is the case I would dispute on
the basis of duplicate accounts.

My Problem- This is a example of one of the cards.

A friend gave me a loan so I could fixes these mess. I settled
with Blatt,Hasenmiller,Laibsker and Moore, LLC on 5-26-05 for $1300.00 I got a credit report and Emerge and Jefferson Capital System were on it. I sent a dispute form on them asking them to charge it from wrote off to Payment after charge off-Settled less than full balance. And they will not do it.I sent every piece of paper I could to help them understand but they still will not fix it. My question is ? How can a company write a debt off, take credit on they income taxes for the write off and turn around an sell it to another company that does the same thing all over again?
Any help you can give me, I would be very thankful for.

Yes it usually is. It says beside how they rank your activity r or i 1-9 9 being bad and 1 being good. r = revovling credit like credit cards. I = installment loans like cars and houses.
settlements mean your account was not paid in full as agreed but usually do change your outstanding balance to 0. For the most part i think and no one knows for sure that a settelment out weighs a 0 balance thus maiking your score lower. how much? I would venture only a guess of up to 40 points on a perfect credit report and as low as 10 on a really bad report.

How are you..... I'm trying to prepare to buy a home ,but my credit score I'm thinking is to low ......its 633 Equifax, 642 Trans union and 661 Experian I got these from a credit report Bank of America did for me from a company called PrivacySource.This repot also shows credit report keys, credit report details,and credit report disputes so pretty extensive as you can see.I have a bankruptcy that I'm hoping will automatically fall off my credit in Oct. 05 it will have been 10 years by than.Will it drop off automatically? IS THE DISHCARGE DATE 10 YEARS AGO? yES NOT 10 YEARS FROM DISHCARGE NO I also have a couple of Medical delinquency that I'm trying to figure out how to handle.I'm not even sure I owe this money.If I do does these types of delinquencies lower my Score? Should I try and contact them to make a arrangement to pay them ABOLUTLEY.....should I ask them to please consider to dismiss the charges? I truly can not afford to pay them if they are mine. Every dollar I'm making is going towards trying to prepare to buy a home meaning the down payment and things like that. I really need some guidance I'm a 43 year old single guy living in my Fathers basement I lost my mother a few years ago to lung cancer and its just time to make a move. The bankruptcy was a major Mistake its been so crippling , but its been ten years now and I'm pretty sure I make enough money to invest in a home (48,000 a year). I've paid down my credit cards I had 4 a year ago and now I only have two with a balance of like 1,000 between the two. MUST HAVE OPEN CREDIT AT ALL TIMES TO HAVE A SCORE. NO OPEN CREDIT IN THE LAST 2 YEARS? NO SCORE. I realized I made a error by closing all 4 of them last year after doing some research this is why I really need help I just don't know what I'm doing.I don't have that much debt really just things like a car payment which is in my dads name ( cosigner) I did it that way to get a better interest rate the payment is $450 a month.I'm hopping to find another car that cost less to cut that payment in half after the bankruptcy falls off my credit report this Oct. I figure I could than go car shopping for a cost of about 10,000 for the car so my payment would only be $225-> $250 a month. Does that sound like the right game plan there? so I can free up more monthly income for my mortgage payment.The other debt is cable bill, cell phone, car Insurance. Things like that. Bankruptcy reported by Citi was wrong, and they do not respond to 5 letters and reported to CRAs.
Cannot get any response from CRAs and they are all different on reports.
Need to get rid of FTC-bunch of lazy ass-holes-waiting to retire on my labor.
You are aggressive and need to review these cases-money is there.

What I really want to talk about here is the fact that attempting to contact Equifax and Experian by phone is nearly impossible!

different names for me, all of them incorrect, my birthdate was wrong, there were several addresses that were incorrect and even my drivers license number was wrong.
Contacting Equifax is a completely different story. I stupidly signed up for their $9.95 a month credit report but had intentions of terminating it before the thirty day offer was up. Well, here is the problem....
It's really easy to sign up and REAL easy to enter your credit card
information so they can take your money but it's impossible to terminate your transaction! I searched and searched the site for the link to terminate my transaction, I'm STILL searching, I am searching for a way to contact Equifax and unless I am going blind, I cannot find the feature to end my membership. By the time I
send a letter by snail mail, Equifax will have sucked another nine dollars from my account.
If you know of any way for me to terminate my subscription with Equifax,
PLEASE let me know!!!

Settlements with creditors. Will these help my credit score

The convoluted web of making contact has made it an impossible task for me to find fax numbers

Hello Bo, I am RP, I live in DC and I am an engineer, going about to get some information cleaned from my report - that I never knew existed. I found it admirable that you took the step to list and help with this information. Your website was also very very informative. I am writing to ask if you could provide me with some additional information. The convoluted web of making contact has made it an impossible task for me to find fax numbers and such. I have papers with proof, letters of apology/recalls etc from the company in some cases the company reporting cant even find reference to their record.
Could you send me information on their fax numbers and contact emails, where they can't ignore my documents, and whom would I contact, hoping this will cut my time in following the trail. Also in your opinion what was the fastest and most effective way to get the items resolved. Also any suggestions on what to do to keep them/organization from doing the same stuff ever again.

When I got my report I had 6 rated at R and U9, needless to say I was shocked, and moved very quickly. I got 4 of them resolved; the Companies have all sent me either apology letters or correcting the error and sending me a report to that effect. However, I am facing a problem with ATT cable and ATT wireless; both are now owned by other companies like Comcast cable and Cingular Wireless. I have paperwork, for the both of them, but it has been impossible to get any form of resolution because I get shuffled back and forth between the credit agency and the companies. Any clues on that. I wrote them numerous emails, called them so many times, the facts
in their system even reflect my statement, but they simply refuse to
issue me a letter or a point of contact to deal with.
What can I do in this situation?

your debt or assest or mistake was passed along then put into like a
mass grave site. Many of these items will come right off with a dispute form.
I'd try the dispute form then see what happens.

When you say a dispute form I am assuming the PDF/word document you put together on your website.
Also I looked into the 3 in 1 credit service at credit.com you listed, does interacting with them and furnishing paperwork to them, mean they can fix this directly as in they have direct access to the database and such. At some point, if your website allows for it, I would also like to contribute to your website anonymously, but have nowhere the same depth as you do. Also did the credit bureaus try to get you to take any off the stuff down... it was so hard trying to find information on the stuff.

What if i have no credit score.

get someone to show you've paid off something or paid well on something other
than utilities and pay to have them included.
under 18? Forget it or string co signor and know the bank
something has to be open within the last 2 years
have'nt used credit in 2 years? You are now a 0.
So why would a reasonable person not have a beacon score
i can find none other than youth.

this company bought a debt that was already charged off by another company

I have an item on my credit report from Asset Acceptance which claims to be a collection account. However, this company bought a debt that was already charged off by another company. Now this company claims that I owe them (not the company I actually owed that already charged this item off). When I called them, they admitted on the phone to me that they BOUGHT this debt from another company and that they're not making a collection specifically for the company they bought it from since it was charged off.
Do they have the right to report this on my credit being that I do not physically owe them a cent? They're a business that bought a debt in hopes to get money out of me... I can't see this being legal. I disputed this item on my credit but it came back as OK because it claims on my credit that they're are a collection for the previous company Bank One) and they aren't! Bank One already charged this item off years ago and then sold it to Asset Acceptance! Is there anything I can do? I can't find a phone number to be able to talk to an actual live person at Experian or Equifax. I keep getting automated systems!

How long can a company use my credit app for inquiries

Third:
One agency shows an account in good standing paid in full with a balance of zero; however, it does not appear on my other files. Show I add this to the other two files and if so what is the process for taking care of this.
Fourth:
How can I write a letter to a credit that informs them to take a specific action-i.e. stop inquiring about my credit report after my acocunt has been paid in full and closed by me, etc. without them changing the last date of activity...

Thats a mouthful and very difficult to answer.
1. No they should not be able to pull your credit back up over and over if you
paid them well. If you have skipped town sometimes creditors can legally use your consent to look and see if you have new entries that mat make it easier to find a skipped town and owes me money person.
2. Long standing issue I have answered a hundred times on my blog and by email. There is not much you can do other than close the account by paying if you owe and ask the item be shown paid in full on such and such date.
3. I do not think bureau will add these items unless you pay and I have never done what you are saying but I know the FTC says we can update and add for a fee. Read FTC laws page on my credit web.
4. Fraud alert. Get my free form on my webpage

Should I pay a settlement collection that is not reported on my credit report

Is it even worth paying the settlement amount to the collection agency or should I just wait the 2 more years for it to come off my reports which will be the 7 year timeline? My fiance and I are trying to obtain a construction loan to start building a house so that is why I need my score to go up.

If we do not pay the collection company they will put it on your account in addition to the other charge off or whatever. So I would say pay them fast and ask that they not report it at all if you pay them. they should do that.

Father Son Merged credit report and sons bad credit.

At the current time, I am not concerned with my own credit or score. It's got to be excellent because I average 3-4 pre-approved credit card offers a week. I have ordered a free copy of both mine & husband's reports just recently, but not the fico scores.

The concern is my husband's account. My husband has never been late on any bill or credit card, ever. The problem is our 36 year old son has the same name and has terrible credit, and it keeps getting reported on my husband's account. Three times over the past 15 years, we have disputed all the incorrect items on his account, gotten it cleared up, and the credit card offers started coming in again (by the way-those are shredded, not applied for). Within 6 months to a year, it's back to the same way it was before. We have finally given up for the past 5-7 years since it seemed that no matter what we did, they would continue to get my son's reports back on my husband's credit.

We can't afford to order his credit report 3 or 4 times a year to keep track
of this, and actually, it gets rather tiring since it takes a minimum of 2 months with back and forth disputing to get something done properly. Is there anything that can be done to make them realize that the birthday/age/social security numbers are not the same and to stop putting reports on the wrong account?

Put a fraud alert on his account with contact info before and other credit is extended. These alerts usually only last about 1 year so you will more than likey have to do it each year. After a few years someone usually gets the point.

I am marked as dead on credit bureaus dat banks. What do I do?

Free Credit Reports, Free Credit Scores, New FTC law

Everyone in the USA is entitled to one free credit report per year from all the consumer reporting agencies. If I desire more or want it fast I can get a report in a bunch of ways.
1 I can mail this letter to the bureaus and get one by mail in about 14 - 30 days. The FTC advocates mail as mail is more secure.
2 Free credit report usually means I buy a credit moitoring service for about 80.00 dollars and get a free report and some live help to questions. If I cancel this service before 30 days I get to keep the report free. So buy monitoring and get a 1 bureau report free.
3 Buy a one bureau report straight out for about 9.50 and add another 5 to upgrade and get a score.
4 Free credit score when I buy the comprehensive 3 bureau report I get a free credit score to go with it. About 35.00

So I can snail mail once per year for Free. 14 - 30 DAYS
I can buy monitoring cancel within 30 days and keep a free credit report. NOW
I can buy one report and upgrade to a score for about 15.00 NOW
I can buy a comprehensive 3 bureau report and get a free credit score. NOW
